REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE VILLAGE OF TAMPICO

Commissioner Jim Coleman called the Regular Meeting of the Tampico Village Council to order at 7:00PM.

Commissioners Jim Coleman, Al Wildman and Scott Meier were present. Commissioner Todd Tornow was absent. Police Officer Will Lukehart and assistant Clerk Jamie McIntire were also present. Village Clerk, Kathy Leathers, recorded the written and audio minutes.

Commissioner Coleman led those present in the Pledge of Allegiance.

Minutes of the April 2, 2019 Regular Meeting were approved as presented.

Amanda Kendall, Manager of Casey’s General Store #1304, was present to request renewal of their liquor license. Following a review of the application, Commissioner Meier motioned, seconded by Commissioner Wildman, that a Class E Liquor License No. 100-35 for Casey’s Retail Company, DBA Casey’s General Store #1304, 201 S. Main Street, be approved from May 1, 2019 to October 31, 2019. The fee of $600.00 has been paid. “Yes” votes were Coleman, Wildman and Meier. The motion carried.

After review of a renewal liquor license application from the Kickback Saloon, Bonnie Anderson, Commissioner Meier motioned, second by Commissioner Wildman, that a Class A Liquor License No. 100-36 for the Kickback Saloon, (Bonnie Anderson), 102 N. Main Street, be approved from May 1, 2019 to October 31, 2019. The fee of $400.00 was paid. “Yes” votes were Coleman, Wildman and Meier. The motion carried.

Commissioner Meier motioned, Commissioner Wildman second, that a Mechanical Amusement Device License No. T-100, for the Kickback Saloon, (Bonnie Anderson), 102 N. Main Street, to operate certain amusement devices from May 1, 2019 to April 30, 2020. The fee of $50.00 has been paid. “Yes” votes were Coleman, Wildman and Meier. The motion carried.

Remarks from Guests
Mayor Hill entered the meeting at this time and apologized for being late due to attending her Grandson’s spring concert.

Village resident Chandler Richmond was present to ask why he and his friends aren’t allowed to ride their four-wheelers around town, but it’s ok for people to ride their side by sides in town. Especially those that don’t seem to be governed down like the golf carts. Mayor Hill said according to our Village Attorney, the side by sides are classified differently than the four-wheelers. Officer Lukehart said we’re following the State Statute set by the Illinois State Police, it’s not just a Village ordinance. It comes down to what is considered an off-highway motor vehicle and what is not. Mayor Hill said it’s such a fine line. Officer Lukehart said we have to follow the Illinois Criminal Code. Commissioner Coleman said it’s not just a Village rule, it’s a State law. Resident David Richmond asked why isn’t the rule for them to be governed
down being enforced? Mayor Hill said some have geared them down. They technically don’t have to as long as they follow the rules of the road. Feel free to turn in those who you observe not following the posted speed limits.

Village resident Beth Etheridge was present with a request for the Village getting stricter rules on burning. Etheridge said she couldn’t even let her dog out a few days ago because the smoke was so bad around her home. Mayor Hill said that burning is suppose to be contained. Etheridge said people are burning while the leaves are wet so it sits there and smolders. Etheridge asked if the Village could have certain days where you’re allowed to burn. There are a lot of kids with asthma and we have a lot of elderly people in town. Mayor Hill said we can review the ordinance and try to tighten it up to help with all that. We do have the brush pile outside of town for Village residents to use. Etheridge suggested people buying the bags that you’re allowed to put the leaves in, take out to the brush pile and the bag along with the contents can all be burned. Mayor Hill said a few years back the Village did away with the burn barrels, but people were suppose to keep the burn piles small and contained and make sure they’re not smoldering. Mayor Hill said maybe we can re-enforce that people aren’t leaving the piles smoldering and unattended. The current hours for burning in the Village of Tampico are Monday through Saturday 8am-7pm and Sunday 1pm-7pm.

Village resident Ron Kuepker asked how things are moving along with the burn house and the condemned houses and junk cars. Mayor Hill said we are not letting up one bit. Clerk Leathers and Officer Lukehart are reminding every other day that it needs to be taken care of. Officer Lukehart has written at least 21 citations to people around town.

Reports of Village Officials
Mayor Hill reported that the Tampico Festival is coming along very well. Mayor Hill checked with the Village attorney and to make sure that all the businesses are protected and that money is being protected and being handled properly, an Mayoral Ad Hoc committee is being appointed for the event. The money will be placed in a special account and it is a public record. There will be another public meeting in the future to see if there is anyone interested in helping with the different committees. We have already began getting sponsors for the event as well. Mayor Hill said it’s coming along nicely and thanks the local businesses for stepping up and helping out. Should be a very fun and safe event. Fencing the event is being worked on to make sure it’s done properly. Porta potties will be available for the event as well. Mayor Hill said we’re making sure to cover all our bases. Resident Deb TerBush asked what would happen if enough money isn’t raised for the event? What would happen to the money that was raised? Mayor Hill said I don’t see that as an issue. Just today there was over $1200 raised and that was just the first day of contacting sponsors. The gates will have a $10 entry fee. Mayor Hill said I don’t want this to fail. If a little risk has to be taken the first year for something good to continue for our town, we’ll make sure to get it figured out. We also have insurance for the event and we will come up with a rescheduled date in case of bad weather, or even look in to having a tent on back up. We also have the gym as a back up option as well. There will be several Plan B’s in place. Clerk Leathers said we’ll check with the Villages insurance carrier and there will be a TULIP policy for the event. There should be incidentals covered in that plan to help with any unforeseen costs due to rescheduling or anything like that. Mayor Hill said we are working with our attorney and insurance to make sure this is a safe, public event. The fireworks have a rain date along with items for us to sell. We’ll have concessions open to help with costs. The mud volleyball sounds like it’s coming together nicely, along with the kids fishing derby. Mayor Hill said I just want to make sure everyone is having a good time and is being safe.

Resident Beth Etheridge asked when will digging for the Water Main Replacement Project begin? Mayor Hill said that will begin this fall or late summer. There is a pre-construction meeting this Monday the 22nd. Etheridge asked if she could pull out the little flags on her property to mow. Mayor Hill said yes because they will have to call JULIE again before they start digging for that project.

Resident Ron Kuepker asked if a daily fee can be charged for containers that aren’t moved. Mayor Hill said yes. Officer Lukehart said we’re on it. Mayor Hill said I don’t want to see this town become a pod nation. Fines have already begun to go out to those individuals.

New Business
The Council began to discuss a Donation for the Tampico Memorial Cemetery. The Village donates to them yearly to help with expenses. Last year $300 was donated and Mayor Hill said I think that would be a good amount to do again this year. The Council agreed and a motion was made by Commissioner Wildman, second Commissioner Meier to donate $300 to the Tampico Memorial Cemetery. “Yes” votes were Coleman, Wildman, Meier and Mayor Hill. The motion carried.

Next the Council discussed the 2019-2020 Appropriations Ordinance NO.O09-19-04-16. Mayor Hill asked if anyone would like anything changed. They did not. Commissioner Coleman asked if it’s in the black. Clerk Leathers said yes, it’s in the black. Leathers said this also includes the Water Main Replacement Project so the grand total of the Appropriation is $3,578,149.35. A motion to approve Ordinance NO.O09-19-04-16 setting forth the Appropriations for the 2019-2020 Fiscal Year being effective May 1, 2019 and Published in Pamphlet Form was made by Commissioner Coleman, second Commissioner Wildman. “Yes” votes were Coleman, Wildman, Meier and Mayor Hill. The motion carried.

A motion was made by Commissioner Wildman, second by Commissioner Meier at 7:32 PM, to leave the regular meeting and go into a closed session to discuss the Appointment, Employment, Compensation, Discipline, Performance or Dismissal of Employees of the Public Body and Possible Action on Any Item Discussed in Closed Session as Allowed by 5 ILCS 120/1 and the Illinois Open Meetings Act. “Yes” votes were Coleman, Wildman, Meier and Mayor Hill. The motion carried.

A motion was made by Commissioner Meier, second by Commissioner Wildman at 7:41 PM to leave the closed session portion of the meeting and return to the regular open meeting. “Yes” votes were Coleman, Wildman, Meier and Mayor Hill. The motion carried.

A motion was made by Commissioner Coleman, second Commissioner Meier, to approve a cost of living raise for Bruce Hill in the amount of $0.50 per hour. “Yes” votes were Coleman, Wildman and Meier. Mayor Hill abstain. The motion carried.

A motion was made by Commissioner Meier, second Commissioner Wildman, to approve a cost of living raise for Jamie McIntire in the amount of $0.50 per hour and approve paying Peggy Hadaway $11.00 per hour. “Yes” votes were Wildman, Meier and Mayor Hill. Commissioner Coleman abstain. The motion carried.

After review of a renewal liquor license application from the Break Room Pub N Grub, Jared Strader – Shayann Bartelt, Commissioner Wildman motioned, second by Commissioner Meier, that a Class A Liquor License No. 100-37 for the Break Room Pub N Grub, LLC, (Jared Strader – Shayann Bartelt), 122 S. Main Street, be approved from May 1, 2019 to October 31, 2019. The fee of $400.00 was paid. “Yes” votes were Coleman, Wildman, Meier and Mayor Hill. The motion carried.

Minutes of the April 2, 2019 Closed Meeting were approved as presented.

Building Permits issued by Zoning Administrator, Ron Kuepker, were 303 S. Main – Addition on South side of house, 103 S. Fremont – Back Porch and 211 Canal – New Roof.

Communications
Clerk Leathers advised the Municipal Minutes informed that the State of Illinois made changed to the Human Trafficking Law that affects all public events. They sent us a brochure for us to post at a prominent place at Village Hall that gives information for those in a bad situation on what to do and how to get away from it. This will also need to be posted in a few prominent places down town during the Tampico Festival, such as the local businesses or even the porta potties.

Leathers then advised that the State passed another bill that will restrict Municipal authority in building inspections, except for a fire, medical or police emergency. That will cover the Village’s interest for any properties in town.

Leathers said that Governor Pritzker signed into the tobacco law that you now have to be 21 years of age to purchase tobacco products.

Bills were ordered paid on a motion by Commissioner Wildman with a second by Commissioner Meier. “Yes” votes were Coleman, Wildman, Meier and Mayor Hill. The motion carried.

The meeting adjourned at 7:54 PM. The next Regular Meeting of the Tampico Village Council will be Tuesday, May 7, 2019 at 7:00 PM in the Reagan Community Center located at 202 W. Second Street.
